1. Overview
These Terms govern the relationship between Independent Musicwear (“the Platform”) and the Artist (band, musician, festival or creator) who wishes to offer merchandise through the Platform.
These Terms apply to Artists. Customer terms are governed by separate Terms of Sale.
By submitting artwork and opening an online shop, the Artist agrees to these Terms.
2. Services Provided
The Platform will:
3. Revenue Share
The Artist receives a fixed amount per product sold, set by the Artist for each product.
The Artist may choose different amounts for different products.
This amount is included in the final retail price and is not added on top of it.
Payments are made through Bank Transfers every last Friday of the month. Payments are gross, artists are responsible for their own tax obligations. The Platform does not act as a withholding agent.
4. Artist Responsibilities
The Artist agrees to:
5. Intellectual Property & License
The Artist retains full copyright to all graphics, artwork, logos, and branding.
By submitting artwork, the Artist grants the Platform a non-exclusive, worldwide, royalty-free license to:
The Artist may revoke this license at any time by closing their shop.
6. Production & Shipping
All products are printed on demand.
Delivery times may vary based on customer location and production availability.
The Platform is responsible for managing printing, packaging, and delivery.
7. Refunds & Returns
All products are printed and produced on demand, specifically for each order.
For this reason, we are unable to accept returns or exchanges for non-defective items.
Refunds
We gladly offer a refund or replacement if:
In such cases, customers must contact us via email at independentmusicwear@gmail.com within 14 days of delivery, including clear photos of the issue, and we’ll make it right.
Cancellations
Orders can be cancelled only before production begins.
Once printing has started, cancellations are no longer possible.
This policy allows us to avoid waste, overproduction, and unsold items — and ensures every product is made intentionally for the person who ordered it.
8. Termination
Either party may terminate the agreement at any time.
Upon termination:
9. Limitation of Liability
To the extent permitted by applicable law, the Platform shall not be liable for:
Liability is limited to the amount earned by the Platform from that Artist’s sales in the previous 12 months.
10. Governing Law
These Terms are governed by Italian law. Custom-made goods are excluded from the standard right of withdrawal under EU law (Art. 59, Consumer Rights Directive).
